1. Who we are

These Terms are an agreement between you and 1001635490 Ontario Inc., carrying on business as PuppyGenes ("PuppyGenes", "we", "us"), 539 Barry Drive, Pickering, Ontario L1V 5M4, 416-315-6352, support@puppygenes.com.

They cover your PuppyGenes account, kit activation, the analysis of your dog's sample, your report, our website and dashboard, and Genie (together, the "Service"). Our Refund Policy forms part of these Terms. Our Privacy Policy explains how we handle information.

Kits are sold on Amazon.ca. The seller shown on your Amazon order handles the sale, payment, delivery and Amazon returns. These Terms cover the Service we provide after purchase. You accept them when you activate a kit; buying a kit or visiting our website does not by itself mean you accept them. If you do not agree, do not submit a sample. You can return an unused kit under the Refund Policy.

2. Who can use the Service

You must be an adult under the law of your province or territory and live in Canada. By activating a kit, you confirm that you own the dog or have the owner's permission to test it, that the sample comes from that dog, and that the information you give us is accurate. We may reject or destroy a sample that is unauthorized, unsafe, human or not from a dog.

Keep your sign-in details private and tell us promptly if you suspect someone else has accessed your account.

3. What the Service includes

Your kit is used to collect a saliva sample from your dog. The sample is analyzed by our laboratory partner and your report is published to your dashboard. The report has six sections: breed ancestry, coat colour, physical appearance, temperament and size predictions, genetic diversity and oral microbiome.

The report does not include genetic disease or health screening. Some results may be unavailable for a given sample. Results usually arrive within 4–6 weeks of posting your sample; this is an estimate, not a guarantee.

Genie is an optional AI helper that answers questions about your dog's published report. It asks for its own consent before first use, and you can use your report without it.

4. Not veterinary advice

PuppyGenes is an informational service. Reports and Genie do not diagnose, treat or prevent disease and do not replace a veterinarian. Do not use them to start, stop or delay veterinary care, medication, treatment, diet changes or breeding decisions. If your dog may be ill, injured or in distress, contact a veterinarian right away. Do not wait for or rely on Genie.

Genie's answers are generated by AI and can be incomplete or wrong. Do not type passwords, payment details, government identifiers or other people's personal information into Genie.

5. Limits of genetic results

Breed, coat, appearance, temperament, size and diversity results are estimates based on current reference data and methods. They may differ from other tests and may change as the science improves. A report can reveal unexpected ancestry. Reports are not certificates of pedigree, identity or suitability for breeding. Oral microbiome results describe the bacteria in the submitted sample at that time; they do not diagnose or rule out dental disease.

6. Samples and the laboratory

By submitting a sample, you authorize us and our service providers, including our U.S. laboratory partner, to receive, analyze and report on it as described in the Privacy Policy. If a sample cannot be processed, the Refund Policy applies.

7. Your data

We use your information as described in the Privacy Policy, including the de-identified uses it describes. We will not sell or share information that identifies you without your separate consent; accepting these Terms is not that consent.

8. Our content and your report

We own the Service, its software, design, content and methods. You may use your account and report for personal, non-commercial purposes, and you may download and share your own report, including with your veterinarian. You must not copy, resell or reverse engineer the Service.

9. Acceptable use

Do not submit a sample you are not authorized to submit, interfere with the Service or its security, scrape or overload it, or use a report or Genie to deceive or harm a person or animal.

10. Your consumer rights and our liability

The Service comes with every warranty, condition and remedy that applicable law does not allow us to exclude, including the legal warranties under Québec law. Nothing in these Terms limits a mandatory consumer right, our liability for our own fault or misrepresentations, or any liability that the law does not allow us to limit.

Subject to those rights, we are not liable for indirect or consequential losses that were not reasonably foreseeable, and where a cap is lawful, our total liability for a kit or its Service is limited to the amount paid for it.

11. Ending the Service

You may stop using the Service at any time. See the Privacy Policy for how to ask us to delete your account. We may suspend part of the Service where reasonably necessary to address fraud, a security risk, unlawful use or a serious breach of these Terms; unless it is urgent, we will tell you first.

12. Governing law and language

If you live in Québec, these Terms are governed by the laws of Québec and Canada and you may bring a claim before any competent court or authority under Québec law. Otherwise, they are governed by the laws of Ontario and Canada, without limiting any mandatory right in your province or territory. Please contact support@puppygenes.com first so we can try to resolve a concern.

French versions of these Terms and the Refund Policy are available at puppygenes.com/fr/legal. If you live in Québec, you are given the French version before contracting and you may choose to contract in English.

13. Changes

We may update these Terms. We will not change the nature or price of a kit or Service you have already bought. Before a change that affects you takes effect, we will email you at least 30 days in advance with the old and new text and the date. If a change increases your obligations or reduces ours, you may refuse it and cancel the affected Service without cost, as allowed by law.

14. General

If part of these Terms is unenforceable, the rest still applies. We may transfer these Terms as part of a sale or reorganization of the business if your rights are not reduced. These Terms, the Refund Policy and any separate consent you give are our whole agreement about the Service.
